  9.                    PIER 1 EXCHANGE LICENSE AGREEMENT

  11. This License Agreement is your Proof of License.
  12.  
  13. This is a legal agreement between you (either an individual or entity),
  14. the end user and Pier 1 (tm) Exchange. If you do not agree to the terms
  15. of this Agreement, promptly return the CD disk package and accompanying
  16. items to the Dealer you obtained it for a full refund.

  18. PIER 1 (tm) SHAREWARE CDROM LICENSE
  19.  
  20. 1.  Copyright and Grant of License:
  21.  
  22. The Pier 1 (tm) CDROM is copyrighted. Pier 1 (tm) Exchange retains
  23. ownership of the enclosed Pier 1 (tm) Shareware CDROM. The Pier 1 (tm)
  24. Shareware CDROM is Licensed to you for use as permitted by this
  25. Agreement.

  27. 2.  Permitted Use:

  29. You may use the Pier 1 (tm) CDROM on compatible computer including
  30. networks. You may use the Pier 1 (tm) CDROM on public or private
  31. Bulletin Board Systems. You may use all of the programs provided on the
  32. CDROM in accordance with the terms of the Authors of the programs in
  33. question. The files listings contained in the BBS directories and TEXT
  34. directory on Pier 1 Shareware CDROM may be imported into a BBS data base
  35. for noncommercial use only.

  37. 3.  Prohibited Use:

  39. You may not rent or lease the Pier 1 (tm) Shareware CDROM. You may not
  40. sublicense the Pier 1 (tm) Shareware CDROM. You may not use the
  41. Pier 1 (tm) Shareware CDROM on a public or private Bulletin Board System
  42. (BBS) in the Buffalo, N.Y. local phone calling area. All file listings
  43. contained in the BBSs directories, and the TEXT directory on the Pier 1
  44. Shareware CDROM are Copyrighted, and any commercial use is prohibited.

  46. 4.  Responsibility of Bulletin Board Systems:
  47.  
  48. File(s) that are found to be commercial or hacked programs by the System
  49. Operator, or as reported to you by the distributor of the CDROM, or by
  50. the Author of the program(s) in question, you must remove the file(s)
  51. name and description from the TEXT, or BBS directory upon receiving such
  52. knowledge of there existence.

  54. Pier 1 (tm) Exchange reserves the right to terminate this License if
  55. there is a violation of its terms or default by the License Holder of
  56. this Agreement. Upon termination for any reason, all copies of the
  57. software must be returned to Pier 1 (tm) Exchange unless instructed to
  58. destroy the CDROM by Pier 1 (tm) Exchange, in either case the Licensed
  59. Holder will be liable for any and all damages suffered as a result or
  60. default.

  62. The Author of the Pier 1 (tm) CDROM and PIER1.EXE software are not
  63. liable for damages suffered as a result of the improper use, proper use,
  64. or inability to use this software. This type of disclaimer is prohibited
  65. by law in some states, and therefore void in those states.
